A last-ditch effort by Lindsay Clancy’s defense attorney to avert a hung jury in her triple-murder case failed as the judge declared a mistrial on Sept. 4.
\n\nDefense attorney Kevin Reddington’s emergency appeal to Massachusetts' highest court was denied after Judge William Sullivan granted him one hour to file the motion.
\n\nSullivan was preparing to declare a mistrial shortly after 11 a.m. ET after the jury sent a third note indicating it remained deadlocked. But Reddington, in a final push, asked to file an emergency single-justice appeal to the Massachusetts Supreme Judicial Court.
\n\nSept. 4 marked the group's seventh day of deliberations in the high-profile murder case. A day earlier, the jury foreperson sent a note to Sullivan alleging that one juror "refused to listen" to the court's instructions on reasonable doubt, Reddington said. At that point, they had been deliberating for more than 36 hours and had been at an impasse for days.
