Perez Hilton‘s mom is asking for custody of his three children amid his mental health hospitalization.

Teresita Lavandeira filed a petition for temporary custody on Aug. 7, just three days after Hilton, 48, livestreamed himself performing acts of self-harm on social media, according to Miami family court records obtained by USA TODAY.

She also requested the case information be sealed, which records indicate the court accepted. Page Six was first to report the filing on Aug. 12.

Lavandeira’s lawyer, Natalie F. Guerra-Valdes, addressed the legal move in a statement to USA TODAY, which was first shared with People, saying, “My main concern and objective, as well as the family’s, is to protect the children and make sure they are safe. We want them to have some sense of normalcy as they begin their journey of healing after the tragic events that occurred last week.”

USA TODAY has reached out to a rep for Hilton for comment.

Why is Perez Hilton hospitalized?

On Aug. 4, police responded to multiple calls about a Hilton livestreaming acts of self-harm from his home in Miami. In an unverified video that circulated online, Hilton appeared to be nude and covered in blood while he held a sharp object and exhibiting signs of distress.

He was later transported to the hospital, where his family said in an Aug. 8 update he was being held under Florida’s Baker Act, a state law that allows an individual to be involuntarily taken to a facility to undergo mental health examinations, according to the Florida Department of Children and Families.

The family’s latest statement also revealed the celebrity blogger – who is father to Mario Armando Lavandeira III, 13, Mia Alma, 11, and Mayte Amor, 8 – was in serious but stable condition, as “he experienced significant blood loss and sustained additional injuries that will require surgery in the coming days.”

“His treatment and recovery will be a long process,” the statement continued, further noting, “there are many false and inaccurate reports circulating in the media regarding Perez and the circumstances surrounding this situation… The only statements regarding Perez that should be considered credible and authorized are those published directly on PerezHilton.com.”

Since the incident, Hilton’s family said “his communication has been extremely limited and confined to immediate family, medical providers, and others directly involved in his care.” One day prior, he was able to spend time with his mother and sister.

In a previous statement, Hilton’s family confirmed his children, niece and sister were inside the home “just minutes before the public livestream.”

“When it became clear that Perez was experiencing a severe mental health crisis and harming himself, they immediately fled to protect the children from witnessing any further trauma,” the family wrote.

“Our highest priority right now is helping the children begin to heal from what they experienced. An important part of that process is allowing them to safely return home and begin rebuilding a sense of security and normalcy.”
